Terms of Service.

These terms apply when you browse, buy from or use The Walls. Please read them; by using the site you agree to them.

Who we are

The Walls (thewalls.art) is run by Chaz Art & Co.. In these terms "we" and "us" mean the operator, and "you" means anyone using the site.

These terms are for buyers and visitors. Artists who license work to us are covered by their own agreement with us, and every artist who sells here signs our Artist Agreement first (see Originality and AI). Where those say something different, they win for the artist.

What we sell

  • Curated prints: work by artists who have licensed it to us. We print it to order and, for limited editions, issue a certificate you can verify.
  • Open Walls prints: work listed by artists themselves. Each listing is reviewed by a person before it goes live, but Open Walls work is not licensed or certified by The Walls. The artist who lists it promises they hold the rights to sell prints of it.
  • Originals: one-off works sold for the artist, shipped from their studio. You ask the artist for a shipping quote to your address first, and buy at that price or not.
  • Digital downloads, where an artist's license allows them.

Placeholder art and artists used while the store is being set up are labeled as such, and are not for sale as real work.

Orders and payment

You can pay in crypto, straight from your wallet to ours, or by card through Stripe's hosted checkout. We never see or store your card number. A crypto price is locked for a short time at checkout; we start your order once the payment is confirmed on the chain.

Prices are shown in US dollars. Shipping is charged at cost and shown at checkout once you give your address. Import duties, VAT and sales tax in your country are not included unless the checkout says so; if they apply, you pay them, usually to the carrier on delivery.

We can refuse or cancel an order, for example if a price was clearly wrong, a payment does not match, or the work has been taken down. If we cancel after you paid, we refund you in full.

Shipping and returns

Prints are made to order and shipped by our print partner. If a print arrives damaged or has a defect, tell us within 14 days and we will reprint it free. Because every print is made for you, we cannot take it back for a change of mind. For an original, we hold your payment until it has reached you. Tell us within 7 days of delivery, with photos, if it arrived damaged (we refund you in full, the shipping included) or is not as described (you send it back, insured, at your cost, and we refund the price and the original shipping once the artist has it back as it left them). In the European Union, the European Economic Area and the United Kingdom you have 14 days, and can also return an original for any reason (you pay to send it back); if it is not as described there, the return costs you nothing. Otherwise originals are final sale. Import duties and taxes, if any, are yours to pay on arrival. Your rights under consumer law in your country are not affected. Full details are on shipping and returns.

The art belongs to the artists

Every artwork on The Walls belongs to its artist (or whoever they got it from). Buying a print gets you that physical print, for your own personal use and display. It does not give you the copyright or any right to copy it.

You may not reproduce, scan, resell as prints, or use any artwork from the site for products, training data or other commercial purposes without the rights holder's written permission. The same goes for our name, logo and site design.

How you may use the site

Please do not:

  • break the law, or help anyone else to;
  • upload or list anything you do not have the rights to, or anything our content policy does not allow;
  • scrape the site in bulk, try to get around security, or disrupt the service;
  • pretend to be someone else, or send false reports or notices;
  • harass artists, buyers or our team.

We may restrict or close an account that breaks these terms. The content policy says what can be listed.

How we moderate content

Curated work comes from artists we have chosen and signed. Open Walls work is listed by artists themselves, so we check it, and this is how:

  • A person reviews every Open Walls listing before it goes live. Nothing is published by a machine alone, except that a seller with a long clean record can have a listing approved automatically when every check is clear.
  • Automated checks compare each image with every image we hold, so the same image cannot be listed twice or come back after it was taken down.
  • An AI model looks at the display image and a reverse image search looks for the same picture elsewhere on the web. Both only advise the person deciding. If a check fails or cannot give an answer, a person decides. Print files are never sent to these services.
  • Anyone can report a work through our notice form, with or without an account. We acknowledge every notice, a person decides it, and we tell the sender what we decided.
  • When we refuse, remove or restrict a work, or suspend an account, we tell the person affected why: what we did, the facts, whether it came from a notice or our own review, whether automated tools were involved, and the rule or law it breaks. We call this a statement of reasons.
  • You can appeal any of these decisions for 6 months, free, through our appeal form. A person looks at it again, not a machine, and answers with reasons. You can also go to court at any time.
  • Copyright and trademark takedowns are strikes. At the limit (currently 3) an Open Walls account is suspended. Notices that are withdrawn, works put back after a counter-notice and decisions reversed on appeal do not count.
  • People who keep sending notices that are clearly unfounded are warned, then we stop handling their notices for a time.

Report a work at /legal/notice, appeal at /legal/appeal, and read the full copyright process at copyright and takedowns. We publish what we did in our transparency report.

Disclaimers

We take care to show colors, sizes and materials accurately, but screens differ and a print can look a little different in person. Room previews and wall previews are a guide, not a promise of how the work will look in your space.

Apart from what these terms and the law say, the site is provided as it is, and we do not promise it will always be available or free of errors.

Limits on our liability

Nothing in these terms limits liability that the law does not allow us to limit, such as for death or personal injury caused by negligence, for fraud, or your rights as a consumer.

Otherwise, we are not liable for losses that were not foreseeable, for business losses, or for losses caused by events outside our reasonable control. Our total liability to you for any order is limited to what you paid for it.

If you upload or list work

If you upload anything to The Walls, you promise you have the right to, and you agree to cover our reasonable costs and losses if someone makes a claim against us because of what you uploaded or because you broke these terms. Artists have fuller promises in the Artist Agreement.

Governing law

These terms are governed by the laws of La Paz, Baja California Sur, Mexico. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim in your local courts.

Changes

We may update these terms. The date at the top shows when they last changed. Changes apply from the day they are posted and do not affect orders already placed. If a change matters to you, we will tell you before it applies where we can.
